Disney and NBCUniversal filed a lawsuit against Midjourney, a generative AI company, claiming it infringes on their copyrights by allowing users to generate images of their characters without permission. The lawsuit cites Midjourney's $300 million revenue and criticizes it for profiting from copyrighted works without investing in their creation. The founders acknowledge there's no way to track the origins of the data used for training. This case represents a significant legal challenge to the use of generative AI and its implications for copyright law in the entertainment industry.
By helping itself to Plaintiffs' copyrighted works, and then distributing images... that blatantly incorporate and copy Disney's and Universal's famous characters - without investing a penny in their creation - Midjourney is the quintessential copyright free-rider and a bottomless pit of plagiarism.
Piracy is piracy, and whether an infringing image or video is made with AI or another technology does not make it any less infringing.
