Mahmoud Khalil's legal team filed a letter in federal court in New Jersey indicating he will challenge Judge Jamee Comans' Sept. 12 decision denying a discretionary waiver from removal. Judge Comans found that Khalil had willfully misrepresented material facts to circumvent the immigration process and ruled that granting a waiver would encourage future material misrepresentations. The ACLU called the misrepresentation charges baseless and pretextual and said those allegations were added after Khalil's detention. Khalil characterized the action as retaliation for his exercise of free speech, accused the administration of fabricating allegations to silence his pro-Palestine advocacy, and seeks $20 million in damages.
