A federal judge criticized the deportation of Kilmar Abrego Garcia, a 29-year-old Maryland father, to El Salvador's dangerous mega-prison. Judge Paula Xinis labeled the government's actions as "wholly lawless", stating there was no substantial evidence against Garcia, who has never faced criminal charges. Despite a court order preventing his deportation, officials admitted to an administrative error but claimed they could not bring him back. Xinis challenged this assertion, insisting the government must comply with legal obligations regarding the safe return of individuals.
US officials "had no legal authority to arrest him, no justification to detain him and no grounds to send him to El Salvador - let alone deliver him into one of the most dangerous prisons in the Western hemisphere."
They do indeed cling to the stunning proposition that they can forcibly remove any person - migrant and US citizen alike - to prisons outside the United States, and then baldly assert they have no way to effectuate return because they are no longer the 'custodian,' and the court thus lacks jurisdiction.
