Eighty-two Democratic members of the U.S. House of Representatives object to the Trump administration's policy restricting passport gender markers to male or female only. The State Department's directive, stemming from an executive order, halts applications for the X gender marker and mandates existing passports must be renewed with an M or F marker. The House members emphasize that this policy risks endangering transgender individuals and challenges their constitutional rights, while also undermining the accuracy of identification processes essential for travel security. Legal action has already been initiated against this new regulation by the ACLU on behalf of seven individuals.
These changes, which the Department of State has stated are pursuant to Executive Order No. 14168, will decrease passport accuracy, subject our transgender, nonbinary, and intersex constituents to potential harassment and violence.
We strongly oppose the changes that would require new passport applications to have only M or F markers, disregarding the validity of existing passports with the X marker.
