The court found that Istvan Forro, a Hungarian national, was discriminated against by Apleona Ireland when he was suspended for feeding a fox, while his Irish coworker faced no penalties.
Deputy Chairwoman Louise O'Donnell emphasized that the lack of action against the Irish employee for similar behavior served as a key evidence of discrimination against Mr. Forro.
Mr. Forro noted that feeding the fox was a common practice among workers, raising questions about whether the client company condoned the behavior, undermining Apleona's disciplinary actions.
Despite an initial ruling by the WRC, the Labour Court's decision highlights the significant disparity in how Apleona addressed the same conduct between different nationalities.
