A recent update to New York City's Human Rights Law requires employers with four or more employees to publicly post their lactation accommodation policies. This update, stemming from Local Law 109 effective May 8, mandates that businesses detail how employees can request access to lactation rooms and clarify the employer's responsibilities to provide clean, private spaces for lactating staff. Different model policies cater to varying workplace environments. Employers must also ensure lactating employees are free from discrimination and receive adequate break time for milk expression.
Employers must now clearly display - in a prominent workplace location - their accommodation room policies, which must outline the process for requesting a lactation room.
The policies also detail the employer's obligations to provide a clean, private space - separate from the bathroom - for lactating employees.
