An Indian tribunal has suspended a five-year ban against WhatsApp's data sharing with Meta, a decision viewed as a significant win for the company. The National Company Law Appellate Tribunal addressed concerns that the ban could threaten WhatsApp's free business model. Meta must pay approximately $12.3 million while awaiting the implementation of India's upcoming digital privacy law. The original ban arose from accusations that WhatsApp was leveraging its market dominance through its privacy policy, which required users to accept expanded data sharing.
We welcome the NCLAT's decision to grant a partial stay on the Competition Commission of India's (CCI) order. Our focus remains on finding a path forward that supports millions of businesses.
The tribunal expressed concern that the five-year ban could threaten WhatsApp's business model, which provides the messaging service free to users.
