MSNBC legal analyst Danny Cevallos warned against prematurely labeling pushback from the federal judiciary regarding President Donald Trump’s actions as a constitutional crisis. He defined such a crisis as one where the Constitution provides no solutions and a significant conflict arises. This caution came in response to recent federal court actions ordering compliance from the Trump administration. Cevallos emphasized that until a court order is disregarded by the administration, declaring a crisis is unwarranted, despite the chaos and executive orders, which the courts have historically managed.
I think we need to be careful with the term constitutional crisis because, as I define it, that would be a situation where the constitution doesn't have an answer and there is a pressing conflict.
The crisis occurs at the moment when there is a court order and the president or the administration refuses to follow it, because historically, we don't really have a clear answer for what to do in that situation.
