Aleckssandro Tomaz Pereira should never have placed workers in this trench until the excavation and the building's foundation were guarded against collapse, workers were properly trained, water was removed from the trench and an exit ladder was provided. This tragedy was entirely preventable.
The investigation revealed that Pereira ordered the victim to enter the trench knowing it was unstable, demonstrating a blatant disregard for worker safety.
OSHA found Pereira in violation of several safety standards, including not providing a safe exit from the trench, inadequate employee training, and failure to waterproof the trench.
Pereira was cited for two willful code violations and six serious violations, and now faces a proposed penalty of $283,115, with 15 days to comply.
