Council Member Nantasha Williams introduced bill Int. 1086-2024, aimed at protecting homeowners against predatory title clouding by mandating timely notifications related to deed and mortgage documents, informed by collaboration with Brooklyn Legal Services Corporation A.
Williams highlighted the impact of clouded titles on low-income families, stating, 'Lacking resources to resolve title defects through legal channels, these homeowners are left vulnerable to significant financial setbacks due to predatory practices that can result in the loss of disaster recovery aid.'
The proposed legislation requires the Department of Finance to email, text, and mail notifications within 30 days of filing deed or mortgage documents, ensuring that homeowners are informed about issues affecting their title.
Williams stated, 'This legislation ensures that property owners are informed and protected against harmful title issues that could jeopardize their property—helping to prevent the cascading financial challenges that clouded titles often create for low-income families.'
