Professor allegedly fired for transgender views wins appeal

The Sixth Circuit Court of Appeals recently ruled that the lawsuit filed by University of Louisville professor Allan M. Josephson can proceed to trial, following allegations of demotion due to his views on gender dysphoria.
Josephson, a psychiatrist, claimed that after expressing his opinions on the treatment of children with gender dysphoria at a panel, he experienced retaliation from his colleagues, leading to his demotion and loss of teaching duties.
The U.S. District Court for the Western District of Kentucky found that the defendants were not entitled to immunity and that Josephson's First Amendment rights were violated, requiring a jury to hear the case.
The appellate decision reaffirms that academic speech, particularly on controversial issues like gender dysphoria, should be protected, allowing Josephson the opportunity to present his case in court.
