This legislation, which mirrors a Senate bill from Senator Josh Hawley, seeks to limit district courts' ability to grant injunctive relief to only involved parties. The Electronic Frontier Foundation (EFF) strongly opposes these bills, arguing they inhibit the judiciary’s role in providing checks on executive actions, especially in light of controversial directives from the Trump administration. EFF insists that existing judicial processes already effectively address issues of injunctive relief.
Congress should firmly oppose any effort to prevent the judicial branch from fulfilling its constitutional duty.
Nationwide injunctions may be necessary to stop nationwide unlawful conduct. And if an injunction was improperly granted, its target can appeal to have it overturned.
