"The commission's annual rule of law report is certainly useful for detecting violations... However, with no direct link to sanctions mechanisms... the report is completely ineffective as an enforcement tool," said Viktor Kazai, highlighting that despite its monitoring capabilities, the absence of enforcement ties renders the report ineffective in addressing genuine violations.
"While it welcomed the commission's commitment to prioritising the rule of law, its triumphant rhetoric on the scale of the problem was unjustified," noted Liberties in their critique, suggesting that the European Commission's positive framing does not align with the reality of democratic backsliding.
