Oakland men plotted robbery outside nightclub, but the victim was armed, police say
Briefly

A 33-year-old man, Jashawndre Upshaw, is charged with murdering his cousin Roosevelt Jones, who was shot during a failed robbery in Oakland. After the shooting, Upshaw brought his cousin to the hospital but wore the same outfit as Jones during the incident, leading to his arrest. Police allege he and Jones attempted to rob a man for a diamond necklace. Surveillance footage contradicts Upshaw's claims about his whereabouts during the incident, resulting in him facing serious charges including murder and attempted robbery.
When he arrived at an emergency room with his cousin, Jashawndre Upshaw was wearing the same outfit as a man who had attempted to rob someone near a nightclub in Oakland.
Upshaw is now being charged with murdering his cousin, under a legal theory that will seek to hold him liable for the actions of the alleged robbery victim.
Surveillance footage from the area, showed the second armed robber alongside Jones in the same outfit Upshaw wore at the hospital, authorities said.
