The administration implemented most tariffs this year under the International Emergency Economic Powers Act (IEEPA). The Court of International Trade ruled in May that IEEPA did not authorize sweeping global tariffs, and an appellate court upheld that ruling. The Supreme Court is set to hear the case in early November. Economists estimate roughly 70% of the tariffs imposed so far would fall if the IEEPA ruling is upheld, though the administration has increasingly used other trade authorities such as Section 232. The plaintiff in the case is V.O.S. Selections, a New York family-run wine importer.
