A 5th Circuit opinion by Judge Andrew Oldham holds that Mississippi violates federal law by accepting ballots postmarked by Election Day that arrive within five days after the election. If the Supreme Court upholds that ruling in Watson v. Republican National Committee, 29 states and the District of Columbia would likely have to amend laws to require receipt of virtually all ballots by Election Day, except limited classes like military and overseas voters. Donald Trump has repeatedly criticized mail-in voting while using it himself and has directed the Department of Justice to pursue litigation supporting stricter receipt rules.
