Sixteen states and Washington DC filed suit arguing the demand overrides Congress's authority that created the $75m Prep program. A federal judge in Oregon temporarily barred the Department of Health and Human Services from cutting funding for the suing states, finding HHS provided no reasonable explanation or evidence for the new grant conditions.
