A federal appeals court granted the Trump administration a temporary victory by staying a trade court ruling that struck down most of Trump's tariffs. This decision follows a lawsuit by five businesses challenging Trump's use of emergency powers for tariffs. The appeals court's order allows the administration time to possibly seek emergency relief from the Supreme Court. Plaintiff lawyer Jeffrey Schwab expressed cautious optimism about the court's scrutiny of the administration's authority under the International Emergency Economic Powers Act (IEEPA).
"The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs," the court ruled Wednesday.
"I think the court understood that the administration's argument that it had essentially unilateral authority to impose whatever tariffs it wanted on any country, at any rate, at any time under IEEPA went too far," Schwab said.
