Criminal law has rarely been applied to many new types of election interference, making it challenging for the justice system to prosecute individuals who directly intervene in elections.
The Supreme Court recently ruled that federal prosecutors had improperly used an obstruction law to prosecute approximately 350 individuals involved in the Capitol riot on Jan. 6, 2021.
