The U.S. Court of Appeals for the First Circuit has ruled against the Trump administration's attempt to revoke deportation protections for migrants under a humanitarian parole program. The court found that the Secretary of Homeland Security lacked a strong case for terminating the parole of over half a million Cubans, Haitians, Nicaraguans, and Venezuelans. This decision allows these migrants to remain in the U.S. while they pursue immigration benefits, following a previous ruling by U.S. District Judge Indira Talwani that blocked the administration's plans to end the program.
For present purposes it suffices to say that the Secretary has not at this point made a 'strong showing' that her categorical termination of plaintiffs' parole is likely to be sustained on appeal.
In mid-April, U.S. District Judge Indira Talwani ruled that the paroled migrants can stay in the United States as they pursue immigration benefits.
