The Trump administration revised its January memo regarding probationary employees, clarifying that the Office of Personnel Management (OPM) is not directing agencies to take performance-based actions. This revision follows a federal court ruling deeming that previous orders likely violated statutes concerning the termination of probationary employees. The American Federation of Government Employees has urged agencies to reinstate those wrongfully terminated, underscoring the contention over the rights of probationary employees and the authority of the OPM in this context.
Every agency should immediately rescind these unlawful terminations and reinstate everyone who was illegally fired. No statute anywhere, ever has granted OPM the authority to direct the termination of employees in other agencies.
In light of a recent court order, OPM issued the revised memo to provide clarity after a federal judge ruled that OPM likely violated multiple statutes regarding termination authority.
