"In it's November motion, Zillow noted that while there are a variety of reasons why it would like to transfer the case, the largest factor is that 10 likely witnesses, which include employees in product, engineering, rentals sales/partnerships, AI/Zestimate, support, takedown processes and finance roles are nearly all located in the Seattle area. According to CoStar, it is due to this that it is now amenable to transferring the case."
Zillow asked to transfer the copyright infringement suit to Seattle, arguing most key witnesses are located there. CoStar alleged widespread unauthorized use of rental listing photos across 49 states and noted nearly one in ten infringements involve properties within 100 miles of the New York courthouse. CoStar emphasized the New York rental market's centrality to Zillow's rental business as a basis for filing in New York. Zillow highlighted ten likely witnesses across product, engineering, rentals sales/partnerships, AI/Zestimate, support, takedown, and finance roles situated near Seattle. CoStar said it is amenable to transfer while reserving the right to contest Zillow's factual and legal assertions and denied that the legal action constituted competitive maneuvering.
