An 'Administrative Error' Sends a Maryland Father to a Salvadoran Prison
Briefly

The Trump administration recently admitted in court to mistakenly deporting Kilmar Abrego Garcia, a Maryland father with protected legal status, to El Salvador due to an administrative error. This marks a rare acknowledgment of errors in deportation cases. Despite this admission, Trump administration lawyers argue that U.S. courts lack jurisdiction to compel the return of Abrego Garcia, who is now detained in a Salvadoran prison. His attorney has requested the court order the administration to facilitate his return, but the government has dismissed this request, citing foreign affairs supremacy.
"Although ICE was aware of his protection from removal to El Salvador, Abrego Garcia was removed to El Salvador because of an administrative error," the government told the court.
Sandoval-Moshenberg stated, 'I've never seen a case in which the government knowingly deported someone who had already received protected legal status from an immigration judge.'
Trump lawyers argued that the court has no ability to bring him back now that Abrego Garcia is in Salvadoran custody, citing 'primacy in foreign affairs'.
The administration’s admission of error in Garcia's deportation is notable, as it acknowledges immigration missteps but maintains that courts cannot intervene.
