Lord Charles Brocket, a 73-year-old celebrity, was convicted of failing to give way to a pedestrian at a zebra crossing in Chelsea. While he argued visibility issues due to a car obstructing his view, video evidence showed him crossing as a pedestrian stepped onto the crossing. After a trial at Wimbledon Magistrates' Court, he was fined £346, ordered to pay £800 in costs, and received three penalty points on his driving license, as the magistrate maintained his defense was insufficient under existing law.
"During the trial, video footage taken by a cyclist appeared to show Brocket riding his Piaggo over the crossing after a pedestrian had already started to cross."
"If the pedestrian is on the crossing it's not a defence," Mr Moss said.
"Under those circumstances case law is clear that if you cannot see that there is a person on the crossing, you must drive in such a way that you can stop if there is a person on it," she said.
"In this instance, the car in front of me slightly obscured anything to the left," Brocket stated.
