
"Police said a Porsche Cayenne SUV and a white Honda Accord, driven by Gillespie, collided around 6 a.m. On Monday, Justice Mark Edwards found that the driver of the Porsche, 26-year-old Haoju Zhou, crossed the centre line on Major Mackenzie Drive and struck Gillespie's car. Mr. Gillespie never had a chance to avoid a collision with Mr. Zhou's vehicle; a collision that ultimately caused his death."
"Edwards also found that Zhou, who was a G2 driver at the time of the crash, was under the influence of alcohol when he fell asleep and lost control of his vehicle. A driver who goes on driving in the knowledge that he or she might fall asleep at any time may be held criminally liable, said Edwards, citing a legal expert on the issue. Bloodwork taken two hours after the collision showed Zhou had a blood alcohol concentration of 93 mg of alcohol in 100 ml of blood. G2 drivers in Ontario cannot have any alcohol in their system."
Travis Gillespie, 38, was killed on Sept. 14, 2022, in a two-vehicle collision on Major Mackenzie Drive E. and Warden Avenue in Markham while driving a white Honda Accord. The other vehicle, a Porsche Cayenne driven by 26-year-old Haoju Zhou, crossed the centre line and struck Gillespie's car. Justice Mark Edwards concluded the impact was a collision, not an accident, and ruled Zhou was under the influence when he fell asleep and lost control. Bloodwork taken two hours after the crash recorded a blood alcohol concentration of 93 mg per 100 ml. G2 drivers in Ontario must have zero alcohol. Zhou was convicted of dangerous and impaired operation causing death and remains on bail pending sentencing January 2.
