The Santa Clara County District Attorney's Office concluded that four police officers acted lawfully when they shot and killed Roberto Rivera Jr. outside a convenience store in September. Rivera, who exhibited erratic behavior, including firing a weapon and threatening patrol officers, pointed a gun at them. Despite repeated pleas to surrender, he threatened the officers' lives, leading to the officers firing their weapons. The findings included evidence of Rivera's substance abuse at the time of the incident, including methamphetamine and alcohol in his system.
On the night of Sept. 8, Rivera sent suicidal group texts to his family, walked into a taqueria on Senter Road and fired several rounds into the ceiling.
Prosecutors said officers Cesar Fernandez, Jessie Gifford, Juan-Carlos Jerez and Brett Vranich believed Rivera intended to gun down their colleagues and opened fire.
