DA Says San Jose Police Lawfully Killed Man on Shooting Spree
Briefly

The Santa Clara County District Attorney's Office ruled that San Jose police officers acted lawfully when they shot and killed Roberto Rivera, Jr. during a chaotic shooting spree. Rivera, exhibiting signs of suicidal intent and intoxication, opened fire in a restaurant and shot a man in the neck before confronting officers while pointing his gun at them. Prosecutor Rob Baker stated that Rivera's actions clearly indicated his desire for officers to shoot him, thus, justifying their lethal response to protect themselves and others.
The officers had no other choice but to employ lethal force in defense of their fellow officers.
Rivera's refusal to drop his gun illustrates his intent to commit 'suicide by cop,' leaving officers with no alternatives.
