The constitutionality of the Johnson Amendment has previously been upheld in two high-profile cases: Christian Echoes National Ministry v. United States and Branch Ministries v. Rossotti, where courts ruled that tax exemption is a privilege, not a right.
However, the Supreme Court has yet to rule directly on the Johnson Amendment's constitutionality, which may be the ultimate goal of NRB's lawsuit.
