Federal judge orders agencies to bring back fired probationary workers

Judge William Alsup of the U.S. District Court for Northern California issued a ruling that criticizes the Office of Personnel Management's (OPM) firing process as a 'sham' and orders several federal agencies to re-hire employees. The ruling coincides with increasing job cuts in the federal workforce, which could affect up to 250,000 employees. Alsup's decision follows a previous order from the Merit Systems Protections Board reinstating 6,000 USDA workers, emphasizing that while agencies can conduct layoffs, they must adhere to legal standards.
"It is sad, a sad day," said Alsup. "Our government would fire some good employees, and say it was based on performance. When they know good and well, that's a lie."
Alsup made clear that it is within an agency's right to conduct a reduction in force, as long as it complies with the law.
This case is really an attempt to do a reduction in force, but to force it through the OPM."
The agencies ordered to re-hire workers include the Department of Agriculture, Department of Defense, and Department of Treasury.
