
"New York Gov. Kathy Hochul signed a bill Thursday that will require advertisers to identify if an ad includes AI-generated people. Hochul's announcement said the bill, S.8420-A/A.8887-B, was the first of its kind in the US, describing it as a "common sense" law that would bring increased transparency and protect consumers."

New York enacted laws requiring conspicuous disclosure when advertisements include AI-generated people and requiring consent from heirs or executors to use deceased individuals' names or likenesses for commercial purposes. The disclosure requirement targets synthetic avatars that do not correspond to real humans and excludes certain expressive works like films, TV shows, and video games when the avatar aligns with the work. Penalties start at $1,000 for a first violation and rise to $5,000 for subsequent violations. The measures aim to increase transparency, protect consumers, and address actors' concerns about AI usage and compensation.
