Michael Pena, an off-duty firefighter, was charged with manslaughter and vehicular manslaughter after causing a fatal collision in East Elmhurst. Driving three times over the speed limit, inhaling alcohol, cocaine, and marijuana, Pena crashed into Justin Diaz's vehicle, who had the right of way. The collision not only resulted in Diaz's death but also illustrated the grave consequences of reckless driving. The incident occurred early on February 26, with Pena's blood alcohol content at .156, far exceeding the legal limit. The tragedy underscores the serious impacts of impaired driving.
According to the charges, at approximately 4:15 a.m., Pena was behind the wheel of a silver Mercedes Benz S63 Coupe traveling eastbound on Northern Boulevard at 83 miles per hour when he blew past a steady red light.
Queens District Attorney Melinda Katz stated, "Drunk and reckless driving often have horrendous consequences," highlighting the severe repercussions of Pena's actions on the victim's life.
Pena's blood alcohol content was measured at .156 percent, significantly exceeding the legal limit, and authorities confirmed he was also under the influence of cocaine and marijuana.
The crash tragically resulted in the death of 23-year-old Justin Diaz, who had been driving with a green light and was on his way to work.
