The town of Los Gatos has authorized legal defense for Vice Mayor Rob Moore and council member Maria Ristow in a defamation lawsuit filed by local activist Lynley Kerr Hogan. After Hogan dropped the initial suit, which included allegations against the two council members, she filed a similar case minimizing their official titles to compel the town to revoke legal support. The council voted unanimously to continue funding the defense but retains the right not to indemnify the members if found liable. The seriousness of using town resources was emphasized by the town attorney.
"The decision to expend town resources is a serious matter, as defending a lawsuit can be time-consuming and expensive," town attorney Gabrielle Whelan said.
"According to meeting minutes from the closed session meeting, the council reserves the right not to indemnify the councilmembers," meaning that the town would not compensate Hogan if Moore and Ristow were found liable.
