A state Supreme Court justice dismissed a lawsuit by the Town of Hempstead against New York Governor Kathy Hochul's congestion pricing plan. Supervisor Don Clavin contended that Hochul's announcement regarding a phased-in $9 toll usurped the MTA's authority and skipped required procedures. The MTA's legal defense argued that the governor's announcement did not equate to the MTA implementing the toll. Justice Arthur Engoron expressed skepticism towards the Town's arguments, ultimately siding with the MTA and granting the dismissal of the lawsuit.
Based on the papers and the arguments, the motion to dismiss is granted,” he said, referring to the MTA filing. “I’m not going to invalidate any actions by the MTA.”
The argument put forth by the Town of Hempstead hinged on claims that Governor Hochul had bypassed necessary procedures and usurped the MTA's authority.
