McMahon stated that while the lawsuit centered on copyright management information, the essence of the plaintiffs' grievance was about OpenAI's development of ChatGPT without compensation.
The judge expressed skepticism about the plaintiffs' allegations, indicating that 'the likelihood that ChatGPT would output plagiarized content from one of [their] articles seems remote,' signaling a challenge to the basis of their case.
Despite the dismissal, Raw Story and AlterNet's attorney, Matt Topic, affirmed their commitment to pursuing the case as they believe they can effectively address the court's concerns in an amended complaint.
