A High Court ruling has stated that the Metropolitan Police do not have the power to dismiss officers solely based on the withdrawal of their vetting clearance. This decision follows the case of Sgt Lino Di Maria, who challenged the lawfulness of the Met's decision after serious allegations against him arose. The ruling, articulated by Mrs. Justice Lang, emphasizes the need for regulatory frameworks set by the Secretary of State to delineate dismissal processes in policing.
"Dismissal is a matter which should be provided for in regulations made by the Secretary of State. This results in an anomalous situation where officers who do not have basic vetting clearance cannot be dismissed by the defendant."
"The ruling had significant implications for the work the Met is now doing to clean up the force," said London Mayor Sir Sadiq Khan.
"The defendant's powers do not extend to the dismissal of a police officer by reason of withdrawal of vetting clearance," stated Mrs Justice Lang.
"In my view, that anomaly could and should be resolved by regulations," emphasized Mrs Justice Lang during the ruling.
