The Civil Service Commission concluded that officer Joseph Abasciano did not engage in misconduct on Jan. 6, and that there was no just cause for his termination.
Commissioner Paul Stein criticized the BPD's third review as being 'far less thorough, more subjective' and lacking a proper explanation for the differing conclusions.
The commission's decision favored two earlier investigations that determined Abasciano did not violate rules, calling the later investigation result-driven.
Abasciano, a respected officer with no prior disciplinary issues, was on sick leave during the Jan. 6 rally, which raised the question of his conduct.
