Convicted former Miami-Dade commissioner asks for new trial, says jurors were misled
Briefly

Suspended Miami-Dade Commissioner Joe Martinez, recently convicted of public corruption, is contesting his verdict by requesting a new trial. His defense argues that the prosecution misrepresented the legislative process, alleging that the term 'creating legislation' implies a collective vote from the entire commission rather than what he was accused of doing alone. They claim no evidence substantiates the charge against him. The judge expressed skepticism about the defense's arguments but will make a ruling on the motion by April 25.
"It's not the case tried before the court. It's not the evidence given to the jury," Kuehne said, referring to the creation of legislation. "We didn't amass any evidence against it."
Miami-Dade Assistant State Attorney Tim VanderGiesen told Judge Miguel M. de la O there was no significant difference in terms regarding the legislation process and intentions.
