The Trump administration's decision to eliminate protected immigration status for over 300,000 Venezuelans, primarily in South Florida, has heightened fears of deportation. Queries from the community mainly revolve around the possibility of evading deportation, particularly for those with U.S. citizen relatives. Legal pathways for adjustment include family-based Green Card applications, predominantly available to close relatives such as spouses and children over 21. Immigration attorney Rebeca Sanchez-Roig emphasizes the importance of legal status and the challenges faced by TPS holders, especially those who entered the country unlawfully or have to process cases through third countries due to unsafe conditions in Venezuela.
If the TPS holder did not enter the country legally, then they have to apply for a Green Card in their home country.
TPS holders who have U.S. citizen children, Sanchez-Roig said, should be aware that their child has to be of age to claim them.
