Democrats, others seek to toss Kennedy off November ballot in Georgia and New York

"The court found, by clear and convincing evidence that petitioners had shown that his New York residence was a sham used for political purposes," lawyer Adam Sparks said after a Monday hearing in Atlanta.
"Mr. Kennedy has been a lifelong resident of the state of New York," lawyer Larry Otter said. Otter emphasized that the challengers are trying to impose additional qualifications beyond constitutional requirements.
Sparks also challenged Kennedy's status as an independent, arguing that since he's running as the nominee of several parties, including his own 'We the People Party,' he doesn't qualify as an independent.
