Karen Read is appealing to the U.S. Supreme Court, seeking to dismiss her second-degree murder charge based on a double jeopardy argument. Her lawyers assert that evidence shows jurors in her first trial reached a non-official agreement to acquit her on two charges. Despite repeated rejections by lower courts, including the state and federal levels, they maintain that forcing her to stand trial again on charges she was previously found not guilty of is unconstitutional. The Supreme Court, however, hears only a small fraction of the petitions it receives.
In sum, the defense learned post-trial that the jury reached a verdict that was not announced; it was entitled to the opportunity to substantiate that fact.
Read is facing re-prosecution by the same prosecutor for the very same offenses - murder and leaving the scene - despite powerful evidence that the jury found her not guilty.
