A Massachusetts judge expressed significant irritation towards attorney Michael Walsh for filing a sentencing memo at 3:30 a.m., just hours before a 10:00 a.m. hearing, where he also arrived late. Judge F. Dennis Saylor IV criticized the lack of justification for the late filing and noted that it disrupted court proceedings. Although frustrated, the judge postponed the sentencing to ensure the defendant Dean Tran could avoid ineffective counsel claims arising from this situation. The incident serves as a caution regarding punctuality and adherence to deadlines in legal proceedings.
I'm unhappy, very unhappy that Mr. Walsh was late, I'm unhappy that Mr. Tran was out in the hall when I took the bench, and what I'm really unhappy about is that this morning the defendant filed a sentencing memorandum that raises a number of issues.
I spent weeks with the sentencing manual trying to figure out which way is up, Walsh said. Most of us were in bed at 3:30 this morning, asleep.
There was a deadline for doing that, which Mr. Walsh blew through... This situation was unfair and inappropriate.
I was certainly not sitting up waiting for you.
