The New Jersey couple suffering from a life-altering car accident cannot sue Uber because their daughter agreed to Uber Eats' terms of service.
'There are physical scars, mental scars, and I don't think that they will ever really be able to go back to their full capacity that they were at before,' says their attorney, Mike Shapiro.
Uber's motion to dismiss aimed to compel arbitration, allowing it to manage disputes outside of court—hence reducing legal costs and keeping proceedings private.
The appeals court stated that the arbitration provision agreed to by Georgia or her minor daughter is valid and enforceable, reversing the previous lower court's decision.
