The complaint says the incident began on May 3 during a Kentucky Derby watch party when Baker entered a women's restroom and Victor waited by the sink. A male security guard entered, banged on the stall door, accused Baker of being a man and shouted for her to leave. After showing Baker's driver's license indicating she is female, the guard ejected them from the hotel. The complaint alleges they were denied access because of Baker's appearance and their lesbian relationship and that hotel executives later crafted a false, defamatory statement suggesting obscene conduct. The lawsuit follows a prior settlement with the Massachusetts Commission Against Discrimination that included updated nondiscrimination policies, anti-discrimination training, and a $10,000 donation to an LGBTQ+ nonprofit.
