He said the claimants' complaints about the "harmful effects" were "shunned and ignored" before the nurses were "penalised and buried" in an "oppressive and ineffectual investigation process" carried out by the trust. Mr Fetto said the policy allowed people access to single-sex spaces "based on self-declared gender identity alone" and there was no consultation with staff about its implementation."

Eight nurses are challenging a County Durham and Darlington NHS Trust policy that allows a person to use single-sex spaces matching their gender identity, after complaints about a transgender colleague using the female changing room at Darlington Memorial Hospital. The nurses allege indirect discrimination, harassment and victimisation under the trust's Transitioning In The Workplace policy. Managers defended the policy as compliant with guidance and law and said the nurses had "demonised" the colleague. Some 26 nurses signed a complaint alleging conduct including staring at colleagues; the colleague denied the allegations as "false". The tribunal heard criticisms of the investigation process and lack of staff consultation.
