Lesbian organization wins appeal in demand to ban trans & bi women from events - LGBTQ Nation
"The court has not endorsed discrimination against trans women, and it has not decided whether the exemption should be granted. It has simply identified legal errors in the tribunal's reasoning, so the matter must now be reconsidered."
"The Commission is not persuaded it is appropriate and reasonable to make distinctions between women based on their biological sex at birth or transgender experience, and to exclude transgender lesbians, from a community event of this kind."
A federal judge in Australia has overturned a previous ruling that allowed the Lesbian Action Group to discriminate against trans and bisexual women. The ruling was based on legal technicalities rather than the case's merits. Heather Corkhill from Equality Australia clarified that the court did not endorse discrimination but identified errors in the tribunal's reasoning. The Lesbian Action Group sought a five-year exemption from the Sex Discrimination Act to exclude trans women from its events, claiming a biological basis for their stance. The Australian Human Rights Commission previously rejected this request.
