The EEOC voted 2-to-1 to rescind its most recent workplace harassment guidance that included examples related to gender identity and sexual orientation. The guidance had cited the Supreme Court's 2020 Bostock decision recognizing discrimination on the basis of gender identity and sexual orientation as sex-based discrimination under Title VII. The guidance included examples of intentional misuse of pronouns and denial of access to restrooms aligned with an employee's gender identity. Chair Andrea Lucas and Commissioner Brittany Panuccio, both Trump appointees, voted to rescind while Commissioner Kalpana Kotagal dissented. Lucas opposes DEI initiatives and federal civil rights protections for transgender people.
