David Herrera registered the pisco brand Pedro Piscal at INAPI in 2023 and launched it in 2024 as a premium 40% pisco sold at $12 a bottle. Actor Jose Pedro Balmaceda Pascal filed a lawsuit seeking annulment, arguing the name induces error and would mislead consumers into believing the actor is behind the product. The actor's law firm said the brand is graphically and phonetically almost identical to his name and breaches good faith, fair competition, and commercial ethics. Herrera's lawyer said the name references the Pedro Jimenez grape and pisco and the bottle image shows a man with a dog, not the actor.
