Kelley Heyer, a TikTok content creator, is suing Roblox over the unauthorized use of her viral dance for Charli XCX's 'Apple.' Despite negotiations for licensing, Roblox released the dance emote before finalizing the agreement, leading to the lawsuit filed in California. The dance was available on Roblox from mid-August until November 2024, selling over 60,000 units and generating $123,000 in sales. Heyer claims her dance, distinct from the song, has been profited from by Roblox without proper compensation, seeking damages and restitution.
Heyer first posted the 'Apple' dance on June 15, 2024, and submitted a copyright application for it on August 30, after Roblox contacted her to license the dance.
Roblox has 'refused to finalize a license agreement' and to compensate Heyer for her dance.
Heyer is looking to the court to award her Roblox's profits on the dance, as well as other damages.
The 'Apple' dance emote was sold until November 2024, earning Roblox an estimated $123,000 in sales.
