The United States Patent and Trademark Office (USPTO) has disclosed a significant error in its patent term adjustment (PTA) calculations, potentially affecting patents issued between March 19, 2024, and July 30, 2024. This includes coding error impacting the "A" delay and the overlap amounts, which could mean that about 1% of patents issued in this timeframe were affected.
The USPTO estimates that approximately 1% of patents issued during the affected period may have been impacted. While many cases saw the overall PTA remain correct due to inaccuracies balancing each other out, some patents experienced discrepancies that did not nullify the errors.
