Jenna Sciabica, a special education language arts teacher at the center of the firestorm, fondled the girl's breasts in a school hallway March 13, the family alleged in court papers.
The accusations have torn the Marlboro, N.J. community apart, with some parents criticizing the district and police for their handling of the case.
The family alleges that Sciabica called the student into her classroom doorway and proceeded to fondle and touch the girl's breasts.
During the incident, Sciabica was described as having a smile on her face while groping the student, who was frozen in shock according to court documents.
